Ein neuer Konkurrent für Schiedsgerichte? – Die Frankfurter Kammer für internationale Handelssachen

Several jurisdictions in the EU establish specialized commercial courts or highly specialized chambers at established courts to resolve commercial disputes between parties from different jurisdictions. Examples are the newly established M&A Court in Düsseldorf or the Chamber for International Commercial Disputes in Frankfurt, Germany. Not only can the proceedings before these courts be conducted in English, but the cases before them are heard and decided by highly specialized judges under special procedural rules which are much more flexible compared to general civil procedural rules. These features are some of the most important ones which set arbitration apart from court proceedings making arbitration the dispute resolution of first choice in international commercial and corporate transactions. It is apparent that these new specialized courts or chambers will compete with international arbitration for the types of disputes in their scope of competence.

On Friday, April 28th, 2023, a distinguished expert panel put together by the Professor Olaf Meyer will discuss the differences between international arbitration and the newly specialized international commercial courts and chambers at the campus of the Frankfurt University of Applied Sciences. I will have the honor to contribute to the panel discussion on enforcement.
